Terms of Service

1. OUR SERVICES

The Services provide AI-generated digital models and images for commercial and personal use. The information and content provided through the Services are not intended for distribution in any jurisdiction where such distribution would be contrary to law or would subject us to registration requirements.

Your Responsibilities:

You agree to comply with all applicable laws and regulations in your jurisdiction regarding use of the Services.
You are solely responsible for ensuring your use of the Services complies with local laws.
The Services are not tailored to comply with industry-specific regulations (HIPAA, FISMA, GLBA, etc.). If your use would be subject to such laws, do not use the Services.

2. INTELLECTUAL PROPERTY RIGHTS

Our Intellectual Property

We are the owner or licensee of all intellectual property rights in the Services, including all source code, databases, functionality, software, website designs, audio, video, text, photographs, graphics (collectively, "Platform Content"), and the trademarks, service marks, and logos ("Marks").

Our Platform Content and Marks are protected by Indian copyright and trademark laws and international treaties. The Services, Platform Content, and Marks are provided "AS IS" for your use in accordance with these Terms.

Your Use of the Services

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access the Services solely for lawful purposes.

Restrictions: You may not copy, reproduce, aggregate, republish, upload, post, publicly display, encode, translate, transmit, distribute, sell, license, or otherwise exploit any part of the Services, Platform Content, or Marks for any commercial purpose without our express prior written permission.

Any breach of these Intellectual Property Rights constitutes a material breach and your right to use the Services will terminate immediately.

3. USER REPRESENTATIONS

By using the Services, you represent and warrant that:

You have legal capacity and agree to comply with these Terms.
You are not under the age of 13.
If you are a minor (under 18), you have received parental permission to use the Services.
You will not access the Services through automated or non-human means (bots, scripts, etc.).
You will not use the Services for any illegal or unauthorized purpose.
Your use will not violate any applicable law or regulation.

If you provide information that is untrue, inaccurate, not current, or incomplete, we may suspend or terminate your account and refuse current or future use of the Services.

4. PRODUCTS, DELIVERY, AND REFINEMENTS

All digital models, assets, and images are custom-created using AI technology and delivered digitally upon purchase.

Availability

Products are subject to availability. We reserve the right to discontinue any products at any time for any reason. Prices are subject to change without notice.

Initial Delivery

Digital products are delivered electronically within 24-48 hours of order confirmation to the email address provided at checkout.

Request Clarifications and Reporting Period

If you believe your delivered product does not meet your specifications, you must report any issues or request clarifications within 1 week (7 calendar days) of delivery. After this period, no complaints, refinement requests, or refund claims will be accepted. This allows us to investigate and act promptly on legitimate concerns.

Refinements and Changes

You may request reasonable refinements or modifications to your delivered model within the 7-day reporting period. Reasonable refinements include:

Minor color adjustments (skin tone, hair color, outfit color)
Small style modifications within original specifications
Pose or angle adjustments
Accessories, or prop changes
Attribute clarifications (size, style consistency)

You cannot make unreasonable demands. Unreasonable demands include requesting completely different models, changing core specifications, requesting unreasonable unlimited revisions, or demands that require re-generation of the entire model as a new product.

Refinement Turnaround

Approved refinement requests will be completed and delivered within 24-48 hours of your request. Our response time to acknowledge your refinement request is 24 hours. Complex refinements may take up to 48 hours.

No Exchanges for Preference Reasons

Once delivered, products cannot be exchanged for alternative designs due to personal preference, change of mind, or dissatisfaction if the original product meets your stated specifications.

No Physical Returns

As this is a digital service, there are no physical returns, exchanges, or traditional "return windows." All transactions are final except as outlined in the Refunds and Returns Policy (Section 6).

5. PURCHASES AND PAYMENT

Your Obligations:

Provide current, complete, and accurate purchase and account information.
Promptly update payment information (email, payment method, card expiration date).
Pay all charges at prices in effect at time of purchase.

Pricing and Taxes

Prices are in USD or the currency specified at checkout. Sales tax will be added as required by law. We reserve the right to correct pricing errors even after payment is requested or received.

Order Refusal

We reserve the right to refuse any order. We may limit or cancel quantities purchased per person, household, or order. We may refuse orders that appear fraudulent, high-risk, or placed by dealers/resellers.

Payment Processing

Payment processing is handled by third-party processors subject to their terms and conditions. Payment disputes must be resolved with your payment processor. We are not liable for payment processing failures or delays caused by third-party providers.

6. REFUNDS AND RETURNS POLICY

General Policy

All sales are final. No refunds will be issued for standard product purchases except as specifically outlined below.

Exceptions to Final Sale Policy

Refunds may be issued only in the following circumstances:

1. Non-Delivery

If a purchased product is not delivered within 1 week (7 calendar days) of order confirmation, you may request a full refund automatically.

2. Requirements Not Met (50% Refund Only)

If the delivered product completely fails to meet the specifications agreed upon at purchase (meaning requirements are met less than 70%), you may request a 50% partial refund within 7 days of delivery by providing clear evidence of the non-conformance.

Conditions for 50% Partial Refund:

Requirements must be met less than 70% (i.e., major discrepancies exist, not minor issues).
You must provide clear, detailed evidence with screenshots/documentation showing the exact specification mismatch.
The defect must not be caused by user error, misunderstanding, or unclear specifications.
Client demands must be reasonable and within the original specifications provided.
If requirements are met 70% or more, no refund applies – this is considered acceptable delivery per your specifications.

Why 50% Partial Refund? We provide this partial refund because MaisonModelX has already expended resources (AI processing, server costs, software licenses) to create and deliver the model. Full refund is not appropriate for partial non-conformance, though we acknowledge the inconvenience and offer 50% recovery of your investment.

3. Full Refund – Non-Delivery After 1 Week

If a purchased product is not delivered within 1 week (7 calendar days) of order confirmation, a full refund will be automatically issued with no further questions required.

4. Compliance with Consumer Protection Laws

In jurisdictions with mandatory consumer protection rights (including India's Consumer Protection Act, 2019), additional refunds may be required by law. We comply with applicable local consumer protection requirements.

Important Limitations on Refunds

No Refund for Change of Mind: Refunds are not issued for change of mind, alternative preferences, or dissatisfaction with the final product if the product meets your agreed specifications (70% or higher conformance).
No Refund for Unreasonable Client Demands: Refunds will not be issued if your expectations were unreasonable or if you made demands outside the scope of the original order specifications.
No Refund for Refinement Requests: Refinement requests (covered in Section 4) are separate from refund claims. Refinements are provided at no additional cost; they are not grounds for refunds.
No Refund After Reporting Period Expires: All refund requests must be submitted within 7 days of delivery. After this period, no refunds will be issued regardless of circumstances.

Refund Process

To request a refund under the above exceptions:

Contact us at maisonmodelx@gmail.com with your order number and detailed reason for the refund request within 7 days of delivery.
Provide supporting evidence (screenshots, specification documentation, detailed description of non-conformance).
Clearly state the percentage of specifications you believe were not met (if claiming 50% refund for non-conformance).
Allow 5-10 business days for review and processing of your request.
Upon approval, refunds will be issued to the original payment method within 10-15 business days.

Refund Decisions: We will review each refund request and make a final determination based on the evidence provided. Our decision is final and binding.

7. COMMERCIAL LICENSE AND ACCEPTABLE USE

License Grant

When you purchase a model from MaisonModelX, you receive a limited, non-exclusive, worldwide, royalty-free, perpetual commercial license to use the purchased digital model subject to the following terms:

Permitted Uses

You may use purchased models for:

Advertising and Marketing: Digital, print, web, and multimedia advertising campaigns
E-commerce: Product listings, storefront imagery, promotional materials
Social Media: Posts, stories, promotional content, social campaigns
Content Creation: Blog posts, articles, newsletters, web content
Commercial Enterprises: Any lawful commercial venture not specifically restricted below

License Restrictions

Non-Transferable: You may not sell, transfer, license, or distribute the model to third parties.
Non-Exclusive: Multiple customers may purchase the same or similar models. You do not receive exclusive rights unless separately negotiated.
No Resale or Redistribution: You may not resell, redistribute, or sublicense the model or any derivative of it as a standalone digital asset.
No Competing Business: You may not use models to create a competing AI model platform or digital model service.
No Impersonation: Models may not be used to impersonate real individuals, suggest real identity, or create deepfakes for fraudulent or harmful purposes.
No Prohibited Industries: Models are not licensed for use in medical diagnosis, pharmaceutical advertising, or regulated industries requiring specialized approval without additional licensing agreements.
Duration: All licenses are perpetual (lifetime) for the purchased version of the model.
Geographic Scope: Licenses are worldwide unless otherwise specified at purchase.

No Third-Party Resale or Licensing

The license to use the purchased model is personal to you and is non-transferable. If any third party requests to purchase, license, or obtain rights to use your purchased model (including requesting the same or similar model from you), that third party must contact MaisonModelX directly to negotiate their own separate license. You are not authorized to sell, transfer, license, sublicense, or grant any third party the right to use your purchased model. All such third-party requests must be directed to MaisonModelX at maisonmodelx@gmail.com to arrange a separate purchase and license agreement. Any unauthorized third-party use of your model resulting from your transfer or sublicense is a material breach of these Terms and your license will be terminated immediately with no refund.

Similar or Duplicate Designs – No Responsibility

We are not responsible for duplicate or similar designs in the following circumstances:

1. Client-Sourced Design Similarities

If the design, clothing, or product specifications you provide to us are similar to or copied from existing designs (fashion items, styles, products from other brands or creators), we are not responsible for potential design infringement, copyright issues, or trademark claims. It is your responsibility to:

Ensure all specifications and design requests are original or properly licensed.
Verify you have the right to use any design elements, patterns, styles, or product descriptions you provide.
Indemnify MaisonModelX from any third-party claims regarding design infringement or intellectual property violations arising from your specifications.

2. Similar Output Models – Not Our Responsibility

If your requested specifications produce an AI-generated model output that is similar to or identical to another customer's model (due to similar input parameters, overlapping attributes, or coincidental AI output similarity), this is not our responsibility.

AI models may produce similar outputs when input specifications are comparable (e.g., same ethnicity, body type, style).
We do not maintain records of all customer outputs or guarantee uniqueness across all orders.
Each model is generated fresh per your order specifications; similarity is a natural consequence of AI technology when similar parameters are used.
You acknowledge that other customers may purchase similar or identical-looking models with overlapping specifications.

You assume all responsibility for:

Verifying your design specifications are original and legally usable.
Accepting that similar input specifications may produce similar AI outputs.
Not holding MaisonModelX liable for design similarities between your order and other customers' orders or existing designs.

8. PROHIBITED ACTIVITIES

You may not use the Services for any purpose other than those for which we make the Services available. As a user, you agree not to:

Systematically retrieve data to create collections, compilations, databases, or directories without written permission.
Trick, defraud, or mislead us or other users to obtain sensitive information.
Circumvent, disable, or interfere with security features of the Services.
Disparage, tarnish, or harm our reputation or the Services.
Use information from the Services to harass, abuse, or harm another person.
Make improper use of support services or submit false reports.
Use the Services inconsistently with applicable laws or regulations.
Engage in unauthorized framing or linking to the Services.
Upload viruses, malware, or material that interferes with use of the Services.
Engage in automated use of the system (scripts, bots, data mining, robots, scraping tools).
Delete copyright or proprietary rights notices from any content.
Attempt to impersonate another user or use another user's username.
Upload passive or active information collection mechanisms (spyware, cookies, web bugs, tracking pixels) without authorization.
Interfere with, disrupt, or create undue burden on the Services or connected networks.
Harass, annoy, intimidate, or threaten our employees or agents.
Attempt to bypass measures designed to prevent or restrict access to the Services.
Copy, adapt, decipher, decompile, disassemble, or reverse engineer any software in the Services.
Use automated systems (spiders, robots, scrapers, offline readers) except standard search engines or browsers.
Make unauthorized use of the Services, including collecting user information for unsolicited communications.
Use the Services to compete with us or for any revenue-generating endeavor beyond your licensed use of purchased models.

Violation of these Prohibited Activities may result in termination or suspension of your rights to use the Services.

9. AI-GENERATED CONTENT DISCLAIMER

Synthetic Nature of Models

All digital models and images created through MaisonModelX are synthetically generated using artificial intelligence technology. The models do not represent real, actual individuals. They are created entirely through AI algorithms and processes.

No Real Identity Representation

Any resemblance of AI-generated models to real persons, living or dead, is entirely unintentional and coincidental. We do not generate models intended to impersonate, misrepresent, or create the likeness of specific real individuals without consent.

User Responsibility for Lawful Use

You are solely responsible for how you use purchased models. You shall not:

Use models in a manner suggesting they represent real individuals without disclosure.
Misrepresent AI-generated models as photographs of real people.
Use models to defame, mislead, defraud, or harm third parties.
Violate any laws or regulations regarding use of the models.
Create deepfakes or synthetic media for unlawful purposes.

MaisonModelX is not liable for user misuse of purchased models in violation of this disclaimer.

Indemnification for Misuse

You indemnify and hold MaisonModelX harmless from any claims, damages, or liability arising from your misuse of models, including but not limited to defamation, fraud, identity theft, or false representation claims resulting from your conduct.

Transparency and Labeling

We recommend users disclose when images are AI-generated where such disclosure is required by law or industry best practices, particularly in advertising and commercial contexts.

10. DATA PROTECTION AND PRIVACY

We are committed to protecting your personal data in accordance with India's Digital Personal Data Protection (DPDP) Act, 2025 and applicable data protection laws.

Data Collection and Use

We collect personal data necessary to provide the Services, process orders, and communicate with you. This includes:

Contact information (name, email, billing address)
Payment information (processed securely by third-party payment processors)
Order and transaction history
Technical data (IP address, browser type, device information)

Legal Basis for Processing

We process your personal data based on:

Consent: You provide consent when you use our Services and provide your information.
Contract Performance: Processing is necessary to fulfill orders and deliver services.
Legal Obligations: Processing is required to comply with applicable laws.

Your Rights

Under Indian data protection law, you have the right to:

Access your personal data we hold about you.
Correct inaccurate or incomplete personal data.
Erase your personal data (subject to legal retention requirements).

Security Safeguards and Data Processing

Third-Party Data Management

All customer orders, specifications, and personal data are collected through our order form on the Services. Upon form submission, all data is securely transferred to and processed through third-party service providers (including CRM and business management platforms). These third-party service providers handle:

Secure storage of customer orders and specifications
Payment processing coordination
Order management and fulfillment tracking
Customer communication and support
Data backup and retention

Third-Party Service Provider Security: All third-party service providers are selected based on their implementation of enterprise-grade security measures including encryption, access controls, regular security monitoring, secure backups, and compliance with international data protection standards (including GDPR).

Our Processing

From these third-party service providers, we retrieve order details and process your request to:

Generate your custom AI model
Deliver your digital files
Provide customer support and refinements

Your Acknowledgment

By submitting your order through our form, you acknowledge that your personal data will be transferred to and processed through third-party service providers as necessary to fulfill your order and provide the Services. You consent to this data transfer.

Security Responsibility

While we rely on third-party service providers' security infrastructure, we remain responsible for the lawful and secure processing of your personal data in compliance with India's DPDP Act, 2025. We do not store sensitive data (full credit card numbers) locally; all payment processing is handled securely by payment processors.

Data Breach Notification

In the event of a personal data breach, we will:

Notify affected users promptly.
Notify the Data Protection Board of India within 72 hours as required by law.

Data Retention

We retain personal data only for as long as necessary to fulfill the purposes for which it was collected, comply with legal obligations, and resolve disputes.

International Data Transfers

The Services are hosted in India. If you access the Services from outside India, your data will be transferred to and processed in India. By using the Services, you consent to this transfer.

Children's Data

We do not knowingly collect personal data from children under 13 without verifiable parental consent. If we learn we have collected such data, we will delete it promptly.

11. USER DATA AND CONTRIBUTIONS

User Data

We will maintain certain data you transmit to the Services for performance management and usage analysis. Although we perform regular backups, you are solely responsible for all data you transmit or activity you undertake using the Services.

We have no liability for loss or corruption of your data. You waive any right of action against us arising from loss or corruption of data.

User Contributions

If you create, submit, or post content to the Services (comments, reviews, feedback, suggestions—collectively "Contributions"), you represent and warrant that:

Your Contributions do not infringe any third-party intellectual property rights.
You own or have necessary licenses, rights, and permissions for your Contributions.
Your Contributions are not false, inaccurate, or misleading.
Your Contributions comply with all applicable laws.

Contribution License

By posting Contributions, you grant us a worldwide, royalty-free, perpetual, irrevocable, non-exclusive, fully paid, assignable, and sublicensable right and license to use, reproduce, modify, translate, transmit, display, and distribute your Contributions.

You retain full ownership of your Contributions. We are not liable for any statements in your Contributions. You are solely responsible for your Contributions and agree to hold us harmless from any claims related to your Contributions.

12. THIRD-PARTY WEBSITES AND CONTENT

The Services may contain links to third-party websites ("Third-Party Websites") and third-party content ("Third-Party Content"). We do not investigate, monitor, or check the accuracy, appropriateness, or completeness of Third-Party Websites or Third-Party Content.

We are not responsible for:

Content, accuracy, opinions, reliability, or privacy practices of Third-Party Websites.
Any purchases made through Third-Party Websites.
Any harm caused by Third-Party Content or Third-Party Websites.

If you access Third-Party Websites or use Third-Party Content, you do so at your own risk. These Terms no longer govern once you leave our Services. You should review the terms and privacy policies of any Third-Party Websites you visit.

You agree to hold us harmless from any losses or harm relating to Third-Party Websites or Third-Party Content.

13. SERVICES MANAGEMENT

We reserve the right, but not the obligation, to:

Monitor the Services for violations of these Terms.
Take appropriate legal action against anyone who violates the law or these Terms.
Refuse, restrict access to, limit availability of, or disable any of your Contributions or portions thereof.
Remove from the Services or disable files and content that are excessive in size or burdensome to our systems.
Otherwise manage the Services to protect our rights and property and facilitate proper functioning.

14. TERM AND TERMINATION

These Terms remain in full force and effect while you use the Services.

We reserve the right to deny access to and use of the Services (including blocking IP addresses) to any person for any reason or no reason, including for breach of any representation, warranty, or covenant in these Terms or applicable law.

We may terminate your use or participation, or delete your account or content, at any time without warning, in our sole discretion.

If we terminate or suspend your account:

You are prohibited from creating a new account under your name, a fake name, or a third party's name.
We reserve the right to take appropriate legal action, including pursuing civil, criminal, and injunctive redress.

15. MODIFICATIONS AND INTERRUPTIONS

We reserve the right to change, modify, or remove contents of the Services at any time without notice. We have no obligation to update information on the Services.

We may modify or discontinue all or part of the Services without notice. We are not liable for any modification, price change, suspension, or discontinuance of the Services.

Service Availability

We cannot guarantee the Services will be available at all times. We may experience hardware, software, or maintenance issues resulting in interruptions, delays, or errors.

We reserve the right to change, revise, update, suspend, discontinue, or modify the Services at any time without notice. You agree we have no liability for any loss, damage, or inconvenience caused by inability to access or use the Services during downtime or discontinuance.

16. DISCLAIMER OF WARRANTIES

THE SERVICES ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. YOU AGREE THAT YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We make no warranties or representations about:

Accuracy or completeness of the Services' content.
Content of any websites or applications linked to the Services.
Prevention of errors, mistakes, or inaccuracies of content.
Personal injury or property damage resulting from your access to the Services.
Unauthorized access to our secure servers or personal/financial information.
Interruption or cessation of transmission to or from the Services.
Bugs, viruses, Trojan horses, or similar items transmitted to or through the Services.
Errors or omissions in any content or loss or damage from use of content posted or transmitted via the Services.

We do not warrant, endorse, guarantee, or assume responsibility for any product or service advertised or offered by a third party through the Services.

We will not be a party to or responsible for monitoring any transaction between you and third-party providers of products or services.

17. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW:

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOST DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

NOTWITHSTANDING ANYTHING TO THE CONTRARY, OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER WILL AT ALL TIMES BE LIMITED TO THE LESSER OF:

The amount paid by you to us in the 12 months preceding the claim, OR
₹10,000 INR (approximately $120 USD)

Certain Indian laws and international laws do not allow limitations on implied warranties or exclusion of certain damages. If these laws apply to you, some of the above disclaimers or limitations may not apply, and you may have additional rights.

18. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless MaisonModelX and our officers, agents, partners, and employees from and against any loss, damage, liability, claim, or demand, including reasonable attorneys' fees and expenses, made by any third party due to or arising out of:

Your use of the Services.
Breach of these Terms.
Any breach of your representations and warranties in these Terms.
Your violation of third-party rights, including intellectual property rights.
Any harmful act toward another user of the Services.

We reserve the right, at your expense, to assume exclusive defense and control of any matter for which you are required to indemnify us. You agree to cooperate with our defense of such claims.

Design and Content Indemnification

In addition to all other indemnification obligations, you specifically agree to defend, indemnify, and hold harmless MaisonModelX from any claims, damages, liability, or legal action arising from:

Design Infringement: Any claim that the design specifications, clothing items, products, styles, or other creative elements you provided to us infringe on third-party intellectual property rights, copyrights, trademarks, or design rights.
Client Content Liability: Any claim that the model output violates laws, regulations, or third-party rights as a result of the specifications or instructions you provided.
Similarity Claims: Any claim of design similarity, duplication, or copying between your ordered model and:
- Existing designs, products, or creative works by third parties
- Other customers' models generated through our Services
- Any other source
Fashion and Product Liability: Any claim that your use of the AI-generated models for fashion, apparel, product design, or commercial purposes violates any third-party rights or applicable regulations.

You assume complete liability and responsibility for all design content, specifications, and usage of the models you purchase. MaisonModelX is not liable for design infringement, similarity, or copyright claims arising from your provided specifications or your use of the delivered models.

19. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of India.

Any dispute arising out of or in connection with these Terms, including any question regarding existence, validity, or termination, shall be subject to the exclusive jurisdiction of the courts of Mumbai, India.

20. DISPUTE RESOLUTION

Informal Negotiation

Before pursuing formal legal action, you agree to first attempt to resolve any dispute informally by contacting us at maisonmodelx@gmail.com. We will attempt to resolve disputes through good-faith negotiation.

Binding Arbitration

If informal negotiation does not resolve the dispute within 30 days, any dispute arising out of or in connection with these Terms shall be referred to and finally resolved by arbitration in Mumbai, India in accordance with the Arbitration and Conciliation Act, 1996.

Governing law: Substantive law of India

Restrictions on Arbitration

The parties agree that:

No arbitration shall be joined with any other proceeding.
There is no right to arbitrate on a class-action basis or use class-action procedures.
There is no right for any dispute to be brought in a representative capacity on behalf of the general public or others.

Exceptions to Arbitration

The following disputes are not subject to binding arbitration:

21. ELECTRONIC COMMUNICATIONS AND SIGNATURES
