AGREEMENT TO LEGAL TERMS

These Terms of Service ("Terms") constitute a legally binding agreement between you (whether personally or on behalf of an entity) and Maison Model X ("MMX," "we," "us," "our") concerning your access to and use of our website at https://maisonmodelx.com/ and all related services (collectively, the "Services").

Maison Model X is an AI-powered digital modeling platform that enables brands, designers, photographers, e-commerce businesses, and creative professionals to purchase custom AI-generated digital models and professional model photography for commercial use. We offer:

  • General AI Model Generation Service: Fully customizable digital model creations with unique attributes (ethnicity, body type, style) and instant delivery for advertising, e-commerce, and social media campaigns.
  • Consistent Faces Service: Custom reference packs featuring photorealistic multi-angle face consistency (95%+ fidelity) for use across AI generation platforms, with dedicated revision support and priority rush delivery options.

BY ACCESSING OR USING THE SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS. If you do not agree with all provisions of these Terms, you are expressly prohibited from using the Services and must discontinue use immediately.

MODIFICATIONS TO THESE TERMS

We reserve the right to modify these Terms at any time. We will alert you to changes by updating the "Last Updated" date at the top of this document. Your continued use of the Services after modifications constitutes acceptance of the revised Terms. We recommend reviewing these Terms periodically to stay informed of any changes.

AGE REQUIREMENTS AND USER ELIGIBILITY

The Services are intended for users at least 13 years of age. Minors under 18 must have parental or guardian permission and direct supervision to use the Services. By using the Services, you represent that you meet these age requirements or have obtained necessary parental consent.

1. OUR SERVICES – DESCRIPTION AND SCOPE

1.1 General AI Model Generation Service

We provide custom AI-generated digital models and images for commercial and personal use. Clients submit specifications (age, ethnicity, body type, clothing, styling preferences, accessories) through our order form. Our AI systems generate custom models based on these specifications, which are delivered digitally within 24–48 hours.

1.2 Consistent Faces Service

Our Consistent Faces Service creates custom reference packs featuring photorealistic facial consistency for repeated use across AI generation platforms (including but not limited to Midjourney, Seedream, Nano Banana, and similar tools). Deliverables include:

  • Multi-angle face reference captures (front, side, ¾ angle, full-body, close-up details)
  • Multiple expressions and poses as specified
  • 95%+ facial consistency guarantees across different AI platforms
  • 4K resolution output files
  • Unlimited revisions during the production phase (included within base price)
  • Optional rush delivery (24-hour turnaround available at additional cost)

1.3 Service Limitations

The Services are not intended for distribution in jurisdictions where such distribution would be contrary to law or would subject us to registration requirements. You are solely responsible for ensuring your use of the Services complies with local laws and regulations in your jurisdiction.

The Services are not tailored to comply with industry-specific regulations (HIPAA, FISMA, GLBA, medical licensing, pharmaceutical regulations, etc.). If your use would be subject to such laws, do not use the Services.

2. INTELLECTUAL PROPERTY RIGHTS

2.1 Our Intellectual Property

We are the owner or licensee of all intellectual property rights in the Services, including all source code, databases, functionality, software, website designs, audio, video, text, photographs, graphics, design systems, and generation algorithms (collectively, "Platform Content"), and the trademarks, service marks, and logos (the "Marks").

Our Platform Content and Marks are protected by Indian copyright and trademark laws, international treaties, and trade secret protections. The Services, Platform Content, and Marks are provided "AS IS" for your use in accordance with these Terms.

2.2 Restrictions on Platform Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access the Services solely for lawful purposes.

You may not:

  • Copy, reproduce, aggregate, republish, upload, post, publicly display, encode, translate, transmit, or distribute any part of the Services, Platform Content, or Marks for any commercial purpose without express prior written permission
  • Reverse engineer, decompile, disassemble, or attempt to discover the source code or algorithms of our AI generation systems
  • Use automated systems (bots, scrapers, spiders, data mining tools) to extract data or generate models in bulk
  • Create competing AI model generation services based on our Platform Content
  • Sublicense or transfer your access rights to third parties
  • Use the Services to train or develop competing AI models

Any breach of these Intellectual Property Rights constitutes a material breach and your right to use the Services will terminate immediately, without refund.

2.3 Your Intellectual Property – Client Content

You retain full ownership of all Client Content—information, specifications, descriptions, reference images, design details, accessories, color palettes, and other materials you provide when placing an order with us.

By submitting Client Content, you grant us a limited, non-exclusive license to use your Client Content solely for:

  • Generating your custom AI models and images
  • Fulfilling your order
  • Providing refinements and revisions within the 7-day window
  • Quality assurance and technical optimization

This license terminates once your order is completed and delivered.

You represent and warrant that:

  • You own or have necessary rights to all Client Content you provide
  • Your Client Content does not infringe third-party intellectual property rights
  • You have permission to use any reference images, design elements, or specifications you submit
  • You take full responsibility for the originality and lawfulness of your Client Content

2.4 Your Intellectual Property – Generated Content and Commercial Rights

Upon full payment of your order, you receive exclusive commercial rights to use the Generated Content (AI-generated model images) we create for you.

Specifically, you receive:

  • Worldwide, perpetual, royalty-free commercial license to use Generated Content for advertising, e-commerce, social media, content creation, and commercial enterprises
  • Non-exclusive rights unless otherwise specified (other clients may purchase identical or similar models)
  • Sublicensing prohibited – you cannot sell, transfer, or license Generated Content to third parties
  • Unlimited derivative uses of Generated Content for your lawful commercial purposes
  • Attribution not required (though we appreciate if you credit MMX)

MMX retains no ownership rights to Generated Content after delivery and full payment. We do not use your Generated Content for:

  • Marketing or promotional purposes without your written consent
  • Training or improving our AI models
  • Portfolio display (unless you explicitly authorize)
  • Any secondary commercial purpose

2.5 Consistent Faces Reference Packs – Ownership and Usage

Upon full payment for the Consistent Faces Service, you receive:

  • Exclusive ownership of the reference face data pack you commissioned
  • Perpetual, worldwide commercial license to use reference packs across any AI generation platforms for unlimited generations
  • No additional licensing fees for using your reference pack across different platforms
  • Right to modify reference packs for your personal use (you may crop, adjust, or adapt for your specific workflow)

You may not:

  • Sell or transfer your reference pack to third parties
  • Sublicense or redistribute your reference pack
  • Allow others to use your reference pack without direct authorization
  • Use your reference pack to create competing reference pack services

If a third party requests to purchase or use your reference pack, they must contact MMX directly to commission their own custom reference pack.

2.6 Portfolio and Marketing Use

If you wish to allow MMX to showcase your Generated Content or Consistent Faces results in our portfolio, marketing materials, case studies, social media, or testimonials, you may grant this permission separately in writing. This permission is optional and not required as a condition of purchase.

You may revoke this permission at any time by contacting us at maisonmodelx@gmail.com.

3. USER REPRESENTATIONS AND WARRANTIES

By using the Services, you represent and warrant that:

  • You have legal capacity to enter into binding contracts and agree to comply with all provisions of these Terms
  • You are not under the age of 13; if under 18, you have obtained verifiable parental permission
  • You will not access the Services through automated or non-human means (bots, scripts, scrapers, etc.)
  • You will not use the Services for any illegal, unlawful, fraudulent, or unauthorized purpose
  • You will not violate any applicable law, regulation, or third-party rights
  • All information you provide (name, email, payment details, specifications) is true, accurate, current, and complete
  • Any Client Content you provide is original, lawful, and does not infringe third-party rights
  • You have the right to use any reference images or design specifications you provide
  • You will use Generated Content in compliance with all applicable laws and regulations
  • You will not use Generated Content to impersonate real individuals, create deepfakes for fraud, or misrepresent AI content as real photography

If any representation is untrue, inaccurate, not current, or incomplete, we may:

  • Suspend or terminate your account immediately
  • Refuse current or future service requests
  • Deny refunds for orders already placed
  • Pursue legal remedies for damages caused by false representations

4. SERVICE SPECIFICATIONS, DELIVERY, AND QUALITY STANDARDS

4.1 Service Workflow and Ordering Process

Step 1: Order Submission
You submit a completed order form providing:

  • Your contact information (name, email, billing address)
  • Model specifications (age, ethnicity, body type, clothing, styling, accessories, color preferences)
  • For Consistent Faces: additional reference images, expression requirements, angle preferences
  • Any special requests or customization details

Step 2: Order Confirmation
We confirm receipt of your order via email within 2–4 hours and provide an estimated delivery date.

Step 3: Generation and Production
Our AI systems generate your custom model(s) based on your specifications. During this phase, quality checks are performed to ensure alignment with your requirements.

Step 4: Delivery
Completed digital files are delivered to your email address in agreed-upon formats (typically PNG, JPG, or TIFF at 4K resolution).

Step 5: Revision Window
You have 7 calendar days from delivery to request refinements or report non-conformance (see Section 4.4).

4.2 Initial Delivery Standards

Delivery Timeframe:

  • Standard delivery: 24–48 hours from order confirmation
  • Rush delivery (Consistent Faces only): 24 hours from order confirmation (additional fee applies)
  • Complex orders with extensive customization may require up to 72 hours; you will be notified at order confirmation

Delivery Method:
All products are delivered electronically to the email address provided at checkout. No physical shipment is offered.

File Formats and Resolution:

  • Default format: High-quality PNG or JPG (as specified at checkout)
  • Resolution: 4K (3840 × 2160 pixels) or lower resolution as specified
  • File size: Optimized for web and print use
  • Consistent Faces: Multi-angle reference files organized by angle and expression

4.3 Product Specifications and Performance Standards

General AI Model Generation:

  • Models will be generated based on your submitted specifications
  • Skin tone, ethnicity, body type, clothing, and styling will match your specifications within reasonable artistic interpretation
  • Generated models will appear photorealistic and professional-grade
  • We make no guarantee that models will be 100% identical to reference images or celebrity likenesses

Consistent Faces Service Guarantees:

  • 95%+ facial consistency guarantee: Facial features (bone structure, proportions, distinguishing characteristics) will maintain 95%+ consistency across multiple angles and expressions
  • Multi-angle delivery: Minimum 5 angles (front, side, ¾, full-body, close-up) plus multiple expressions as specified
  • Cross-platform consistency: Reference pack will maintain consistency when used across different AI platforms (with inherent platform-specific variations acknowledged)
  • 4K resolution: All reference files delivered at 4K quality
  • Revision inclusion: Unlimited revisions during production phase to achieve consistency standards

Output Limitations:

  • Models are synthetic and do not represent real individuals
  • We cannot guarantee models will look identical to any specific celebrity or real person (though we can create stylistically similar models within ethical guidelines)
  • We cannot guarantee 100% consistency across all future AI generations (platform differences and algorithm updates affect output)
  • Consistency is measured relative to your reference pack within reasonable AI generation parameters
  • Natural variation in AI outputs across different tools is expected and not grounds for refunds

4.4 Reporting Period and Quality Disputes

Reporting Window: If you believe your delivered product does not meet your specifications, you must report issues within 7 calendar days of delivery. After this period, no complaints, refinement requests, or refund claims will be accepted.

This window allows us to investigate and act promptly on legitimate concerns and prevents indefinite dispute periods.

Report Process:

  1. Email maisonmodelx@gmail.com with your order number and detailed description of the issue
  2. Include screenshots or documentation showing the exact specification mismatch
  3. Clearly state what specification was not met and how it differs from your order
  4. Our team will acknowledge your report within 24 hours

4.5 Refinements and Reasonable Modifications

Included Refinements (Covered Under Base Price):

You may request reasonable refinements or modifications to your delivered model within the 7-day reporting period. Reasonable refinements include:

  • Minor color adjustments (skin tone, hair color, outfit color, accessory color)
  • Small style modifications within original specifications
  • Pose or angle adjustments
  • Accessories or prop changes
  • Attribute clarifications (size, style consistency, styling details)
  • Expression or facial feature fine-tuning (eyes, smile, etc.)
  • For Consistent Faces: adjustment of any angle to better match consistency standard

Unreasonable Demands (Not Covered):

You cannot make unreasonable demands. Unreasonable demands include:

  • Requesting a completely different model (different ethnicity, body type, fundamental appearance)
  • Changing core specifications beyond minor adjustments
  • Requesting unlimited revisions beyond the 7-day window
  • Demanding re-generation of the entire model as a new product
  • Requesting models that require completely different artistic direction
  • Requesting additional deliverables not included in your service tier

Refinement Turnaround:

  • Our acknowledgment time: 24 hours from receipt of your refinement request
  • Approved refinement completion: 24–48 hours from request
  • Complex refinements involving multi-angle regeneration (Consistent Faces): up to 48 hours

Refinement Delivery:
Refined products are delivered via email to the same address as original delivery.

4.6 Non-Exchanges for Preference or Dissatisfaction

Once delivered, products cannot be exchanged or replaced for:

  • Personal preference or change of mind
  • Dissatisfaction with the aesthetic or style (if specifications were met)
  • Alternative designs (without grounds of non-conformance)
  • Any reason other than non-conformance to specifications or non-delivery

If you simply prefer a different model despite the current one meeting your specifications, you must place a new order and purchase a different model. No refund will be issued for preference-based requests.

4.7 No Physical Returns

As this is a digital service, there are no physical returns, exchanges, or traditional return windows. All transactions are final except as outlined in the Refunds and Returns Policy (Section 6).

Once a digital product is delivered, it is your responsibility. We cannot "return" or delete digital files you have received.

5. PURCHASES, PAYMENT, AND PRICING

5.1 Accepted Payment Methods

We accept the following payment methods:

  • Visa, Mastercard, American Express, Discover
  • PayPal
  • Other payment methods as displayed at checkout
  • Bank transfers (when arranged in advance)

5.2 Your Payment Obligations

You agree to:

  • Provide current, complete, and accurate purchase and account information
  • Promptly update payment information (email, payment method, card expiration date) if it changes
  • Pay all charges at prices in effect at the time of purchase
  • Pay all applicable taxes, duties, and fees as required by law
  • Authorize charges to your payment method

5.3 Pricing, Currency, and Taxes

Pricing Structure:

Prices vary based on service tier and customization level:

  • General AI Model Generation: $5–$40 USD per model (depending on complexity, angles, revisions included)
  • Consistent Faces Service: $80–$400 USD per reference pack (depending on complexity, number of angles, expressions, and revision inclusions)
  • Rush Delivery (24-hour): +$20–$50 USD additional fee

Prices are displayed in USD or the currency specified at checkout. All prices are subject to change without notice.

Sales Tax:
Sales tax will be added as required by law. Tax rates vary by jurisdiction.

Pricing Errors:
We reserve the right to correct pricing errors even after payment is requested or received. If a pricing error occurs, we will contact you before charging and offer the option to cancel.

Price Modifications:
We reserve the right to change prices at any time. Price changes apply to new orders only, not orders already placed.

5.4 Order Refusal and Limitation

We reserve the right to refuse any order for any reason, without explanation, including:

  • Orders that appear fraudulent or high-risk
  • Orders placed by resellers or dealers
  • Orders violating these Terms or applicable law
  • Orders for prohibited purposes (deepfakes, identity fraud, harassment)
  • Orders that would exceed our production capacity

We may limit quantities purchased per person, household, or order to prevent abuse.

5.5 Payment Processing and Responsibility

Payment processing is handled by third-party payment processors (Stripe, PayPal, etc.) subject to their terms and conditions. We are not responsible for:

  • Payment processing delays or failures
  • Payment disputes or chargebacks
  • Third-party processor errors or system failures
  • Fraud or unauthorized use of payment methods

Payment disputes must be resolved directly with your payment processor. We will cooperate with legitimate dispute investigations.

6. REFUNDS AND RETURNS POLICY

6.1 General Policy

ALL SALES ARE FINAL. No refunds will be issued for standard product purchases except as specifically outlined below in Section 6.2.

6.2 Exceptions to Final Sale Policy – Refund Eligibility

Refunds may be issued only in the following circumstances:

6.2.1 Non-Delivery (Full Refund)

Eligibility: If a purchased product is not delivered within 7 calendar days of order confirmation.

Refund Amount: Full refund of order price (100%)

Process: Contact us at maisonmodelx@gmail.com with your order number. Full refund will be processed automatically with no further questions required.

6.2.2 Requirements Not Met – Partial Refund (50%)

Eligibility: If the delivered product completely fails to meet the specifications agreed upon at purchase, meaning requirements are met less than 70% (i.e., major discrepancies exist, not minor issues).

Refund Amount: 50% partial refund of order price

Why 50% Partial Refund?
MMX has already expended substantial resources (AI processing, server costs, software licenses, time) to create and deliver your model. A 50% partial refund acknowledges non-conformance while recognizing resource expenditure. Full refund is not appropriate for partial non-conformance.

Conditions for 50% Refund:

  • Requirements must be met less than 70% (e.g., ordered a fair-skinned model but received dark-skinned model, or ordered female model but received male)
  • You must provide clear, detailed evidence with screenshots or documentation showing the exact specification mismatch
  • The defect must not result from user error, unclear specifications, or misunderstanding
  • Client demands must be reasonable and within the original specifications provided
  • If requirements are met 70% or higher, no refund applies – this is considered acceptable delivery per your specifications

Proof Required:

  • Original order specifications (screenshot of order form)
  • Delivered model screenshots showing the mismatch
  • Written explanation of which specifications were not met and by how much
  • Percentage estimate of non-conformance (e.g., "only 40% of specifications met")

6.2.3 Full Refund for Service Unavailability

Eligibility: If MMX experiences catastrophic system failure or force majeure event preventing delivery.

Refund Amount: Full refund (100%)

Process: We will contact you and offer a full refund or remake of your order at no additional cost.

6.2.4 Compliance with Consumer Protection Laws

In jurisdictions with mandatory consumer protection rights (including India's Consumer Protection Act, 2019), additional refunds may be required by law. We comply with applicable local consumer protection requirements.

6.3 Important Limitations on Refunds

NO REFUND FOR CHANGE OF MIND:
Refunds are not issued for change of mind, alternative preferences, or aesthetic dissatisfaction with the final product if the product meets your agreed specifications (70% or higher conformance).

NO REFUND FOR UNREASONABLE DEMANDS:
Refunds will not be issued if:

  • Your expectations were unreasonable or unclear
  • You made demands outside the scope of the original order specifications
  • You requested unlimited revisions beyond what is reasonable
  • You changed your requirements after delivery

NO REFUND FOR REFINEMENT REQUESTS:
Refinement requests (covered in Section 4.5) are separate from refund claims. Refinements are provided at no additional cost within the 7-day window; they are not grounds for refunds.

NO REFUND AFTER REPORTING PERIOD EXPIRES:
All refund requests must be submitted within 7 calendar days of delivery. After this period, no refunds will be issued regardless of circumstances. This deadline is absolute and final.

NO REFUND FOR MISUSE:
If you misuse Generated Content (using for deepfakes, impersonation, fraud, or other prohibited purposes), your refund request will be denied and your account may be terminated.

6.4 Refund Process

To request a refund:

  1. Contact Us: Email maisonmodelx@gmail.com with your order number within 7 days of delivery
  2. Provide Justification: Clearly state your refund reason and supporting evidence:
    • For non-delivery: order number and delivery deadline
    • For non-conformance: specification mismatch documentation and percentage of non-conformance
    • Screenshots and detailed description of the issue
  3. Wait for Review: Allow 5–10 business days for our review and determination
  4. Receive Decision: We will email you with our final determination (approval or denial)
  5. Processing: Upon approval, refund will be issued to your original payment method within 10–15 business days

Refund Decisions:
Our determination is final and binding. We will consider all evidence and make a fair, objective decision. You may not appeal refund decisions or escalate to payment processors without our written consent.

Timing Matters:
Refunds processed after the 7-day window will be denied. Timely submission is essential.

7. COMMERCIAL LICENSE AND ACCEPTABLE USE

7.1 License Grant

When you purchase a model or Consistent Faces reference pack from MMX, you receive a limited, non-exclusive, worldwide, royalty-free, perpetual commercial license to use the purchased digital content subject to the following terms.

This license is personal to you. You may not transfer, sublicense, or grant it to third parties.

7.2 Permitted Uses

You may use purchased models or reference packs for:

Advertising and Marketing:

  • Digital, print, web, and multimedia advertising campaigns
  • Promotional materials and product launches
  • Social campaigns and brand awareness initiatives

E-commerce:

  • Product listings and storefront imagery
  • Catalog photography and item showcases
  • Promotional and seasonal campaigns

Social Media:

  • Posts, stories, reels, and promotional content
  • Social campaigns and influencer-style content
  • Portfolio building and self-promotion

Content Creation:

  • Blog posts, articles, newsletters, and web content
  • Ebooks, guides, and informational materials
  • YouTube thumbnails, video thumbnails, and streaming content

Commercial Enterprises:

  • Fashion and jewelry brand applications
  • Photography and design service offerings
  • Any lawful commercial venture (subject to restrictions below)

Editorial and Publishing:

  • Magazine covers and editorial imagery
  • Book covers and promotional materials
  • News and journalistic use (with ethical disclosure)

7.3 License Restrictions – Prohibited Uses

Non-Transferable and Non-Exclusive:

  • Your license is personal to you and may not be sold, transferred, licensed, or distributed to third parties
  • Multiple customers may purchase the same or similar models; you do not receive exclusive rights
  • If any third party requests rights to your purchased model, they must contact MMX directly

No Resale or Redistribution:

  • You may not resell, redistribute, or sublicense the model or any derivative as a standalone digital asset
  • You may not bundle your model with other products for sale
  • You may not create competing model libraries using our Generated Content

No Competing Business:

  • You may not use models to create a competing AI model platform or digital model service
  • You may not build a model library business based on MMX Generated Content
  • You may not offer "similar models" as a competing service

No Impersonation or Deepfakes:

  • Models may not be used to impersonate real individuals or suggest real identity
  • Models may not be used for fraudulent, deceptive, or malicious purposes
  • Models may not be used to create deepfakes for harassment, defamation, or identity theft
  • Models may not be used to mislead audiences about the authenticity of content

No Prohibited Industries (Without Additional Licensing):
Models are not licensed for use in:

  • Medical diagnosis or treatment recommendations
  • Pharmaceutical advertising or regulated drug promotion
  • Financial services advertising (without additional regulatory compliance)
  • Political campaign advertising (without explicit approval)
  • Misleading or deceptive commercial practices

Geographic Scope:
Licenses are worldwide unless otherwise specified at purchase. No geographic restrictions apply.

Duration:
All licenses are perpetual (lifetime) for the purchased version of the model. Even if MMX discontinues its business, your license to use purchased content persists.

7.4 Similar or Duplicate Designs – No Responsibility

We are not responsible for duplicate or similar designs in the following circumstances:

7.4.1 Client-Sourced Design Similarities

If the design, clothing, product specifications, accessories, or style you provide to us are similar to or copied from existing designs (fashion items, styles, products from other brands, designers, or creators), we are not responsible for potential design infringement, copyright issues, trademark claims, or intellectual property disputes.

It is your responsibility to:

  • Ensure all specifications and design requests are original or properly licensed from rights holders
  • Verify you have the legal right to use any design elements, patterns, styles, or product descriptions you provide
  • Obtain necessary permissions before requesting designs based on existing works
  • Indemnify MMX from any third-party claims regarding design infringement

You assume complete liability for design originality and legal compliance regarding your specifications.

7.4.2 Similar Output Models – Not Our Responsibility

If your requested specifications produce an AI-generated model output that is similar to or identical to another customer's model (due to similar input parameters, overlapping attributes, or coincidental AI output similarity), this is not our responsibility.

Important Acknowledgments:

  • AI models naturally produce similar outputs when input specifications are comparable (e.g., same ethnicity, body type, style, or clothing)
  • We do not maintain records of all customer outputs or guarantee uniqueness across all orders
  • Each model is generated fresh per your specifications; similarity is a natural consequence of AI technology
  • You acknowledge that other customers may purchase similar or identical-looking models with overlapping specifications
  • Similarity is not grounds for refunds or complaints

You assume all responsibility for:

  • Verifying your design specifications are original and legally usable
  • Accepting that similar input specifications may produce similar AI outputs
  • Understanding AI output variability and natural similarities
  • Not holding MMX liable for design similarities between your order and other customers' orders or existing publicly available designs

8. PROHIBITED ACTIVITIES AND CONTENT RESTRICTIONS

You may not use the Services for any purpose other than those for which we make them available. As a user, you agree not to:

  • Use Generated Content for deceptive marketing or false advertising

Intellectual Property Violations:

  • Delete copyright or proprietary rights notices from any content
  • Copy, reproduce, or distribute content without authorization
  • Use the Services to develop competing AI platforms
  • Claim ownership of Generated Content you did not purchase
  • Violate third-party intellectual property rights

Competitive and Commercial Abuse:

  • Use the Services to compete directly with MMX's business model
  • Resell Generated Content or reference packs as your own
  • Create a derivative competing service using our outputs
  • Use the Services for revenue-generating endeavors beyond your licensed use of purchased models

Violation of Applicable Law:

  • Use the Services inconsistently with applicable laws or regulations
  • Create, distribute, or use content for illegal purposes
  • Violate consumer protection laws or fraud statutes
  • Violate data protection or privacy laws
  • Engage in money laundering, terrorist financing, or sanctions violations

Destructive Activities:

  • Make improper use of support services or submit false reports of problems
  • Make false abuse reports or spam complaints to our support team
  • Attempt to extort or blackmail MMX or other users

8.1 Enforcement and Consequences

Violation of these Prohibited Activities may result in:

  • Immediate termination of your access to the Services
  • Forfeiture of refunds or credits
  • Deletion of your account and associated data
  • Reporting to law enforcement or relevant authorities
  • Civil and criminal legal action

9. AI-GENERATED CONTENT DISCLAIMER

9.1 Synthetic Nature of Models

ALL digital models and images created through MaisonModelX are synthetically generated using artificial intelligence technology. The models are not real, actual individuals. They are created entirely through AI algorithms, machine learning processes, and computational generation. No real person posed for or appears in Generated Content.

9.2 No Real Identity Representation

Any resemblance of AI-generated models to real persons, living or dead, is entirely unintentional and coincidental. We do not intentionally generate models designed to impersonate, misrepresent, or create the likeness of specific real individuals without express written consent from those individuals.

We do not generate:

  • Models designed to look exactly like celebrities or public figures without explicit consent
  • Models intended to deceive audiences about their synthetic nature
  • Deepfakes or synthetic media designed for fraud or harmful purposes

If a model incidentally resembles a real person, this is a natural consequence of AI generation using human-like specifications and is not intentional.

9.3 User Responsibility for Lawful Use

You are solely responsible for how you use purchased models. You shall not:

  • Use models in a manner suggesting they represent real individuals without clear disclosure that the image is AI-generated
  • Misrepresent AI-generated models as photographs of real people
  • Use models to defame, mislead, defraud, or harm third parties
  • Violate any laws or regulations regarding use of the models

MMX is not liable for user misuse of purchased models in violation of this disclaimer.

9.4 Transparency and Industry Best Practices

We recommend users disclose when images are AI-generated where such disclosure is:

  • Required by law or regulation
  • Industry best practice (e.g., advertising, media)
  • Necessary for ethical or consumer protection reasons
  • Expected by your audience or platforms

Clear disclosure prevents deception and builds consumer trust.

9.5 Indemnification for Misuse

You indemnify and hold MMX harmless from any claims, damages, or liability arising from your misuse of models, including but not limited to:

  • Defamation or libel claims resulting from your use of models to suggest false identity

16. LIMITATION OF LIABILITY

IN NO EVENT WILL MMX, OUR DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE TO YOU OR ANY THIRD PARTY FOR:

NOTWITHSTANDING ANYTHING TO THE CONTRARY, OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER WILL AT ALL TIMES BE LIMITED TO THE LESSER OF:

  1. The amount paid by you to us in the 12 months preceding the claim, OR
  2. ₹10,000 INR (approximately $120 USD)

Client Content Liability:

  • Any claim that Generated Content violates laws, regulations, or third-party rights as a result of the specifications or instructions you provided

Similarity Claims:

  • Any claim of design similarity, duplication, copying, or infringement between your ordered model and:
    • Existing designs, products, or creative works by third parties
    • Other customers' models generated through our Services
    • Any other public or private source

Fashion and Product Liability:

  • Any claim that your use of AI-generated models for fashion, apparel, product design, jewelry, or commercial purposes violates third-party rights or applicable regulations

Identity and Impersonation:

  • Any claim that you used Generated Content to impersonate, misrepresent, or deceptively reference real individuals

17.3 Assumption of Liability

You assume complete liability and responsibility for:

  • All design content and specifications you provide
  • Originality and legal compliance of Client Content
  • Usage of Generated Content consistent with applicable law
  • Proper disclosure of AI-generated nature when required

MMX is not liable for design infringement, similarity, copyright claims, or legal violations arising from your provided specifications or your use of Generated Content.

17.4 Cooperation

You agree to cooperate fully with our defense of any indemnified claim, including:

  • Providing necessary documentation and evidence
  • Making reasonable adjustments to your defense strategy
  • Not settling claims without our consent
  • Responding promptly to legal inquiries

18. GOVERNING LAW AND JURISDICTION

18.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles or principles that would apply the laws of another jurisdiction.

18.2 Exclusive Jurisdiction

Any dispute arising out of or in connection with these Terms, including any question regarding existence, validity, or termination, shall be subject to the exclusive jurisdiction of the courts located in Mumbai, Maharashtra, India.

  • You understand the synthetic and AI-generated nature of all Generated Content
  • You accept the limitations of warranties and liability described herein
  • You understand the refund policy and reporting deadline (7 days)
  • You accept all risks associated with using AI-generated models
  • You will comply with all laws and regulations
  • You will use Generated Content lawfully and ethically
  • You will not violate third-party rights or the rights of real individuals

25.2 Acceptance

Your use of the Services constitutes your full acceptance of these Terms, including all representations, warranties, disclaimers, and limitations of liability.

25.3 Disagreement

IF YOU DO NOT AGREE WITH ANY PROVISION OF THESE TERMS, YOU MUST DISCONTINUE USE OF THE SERVICES IMMEDIATELY. Continued use constitutes acceptance.
